Terms of Service

1. Acceptance

By creating an account on wormgpt.net ("the Service") or using any feature of WormGPT, you agree to be bound by these Terms of Service ("Terms") and our practices described below. If you do not agree, do not use the Service.

2. Service description

WormGPT is an AI assistant designed for cybersecurity professionals, researchers, students, and developers. It helps with defensive security, offensive security in authorized contexts, software engineering, and general technical questions. WormGPT is provided as a hosted Software-as-a-Service product accessed through a web interface or API.

The Service is not a substitute for professional legal, compliance, security, or engineering advice. AI outputs may contain errors or out-of-date information; you should verify anything critical before relying on it.

3. Account eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • You must provide a valid email address and a unique username. You are responsible for keeping your credentials secure.
  • One person should not operate multiple accounts to circumvent rate limits, plan limits, or enforcement actions.
  • We may suspend or terminate accounts that violate these Terms, with or without notice.

4. Acceptable use

You agree to use the Service only for lawful purposes and only in ways that comply with all applicable laws, regulations, and the rights of others. This includes (without limitation):

  • Only directing offensive-security testing or analysis at systems, networks, accounts, applications, or data that you own or for which you have explicit written authorization from the owner (for example: contracted penetration test scope, bug bounty programs with public scope, your own lab or VM, CTF or academic exercise).
  • Complying with all applicable anti-hacking, computer fraud, data protection (including the GDPR where applicable), intellectual property, export control, and sanctions laws in your jurisdiction.
  • Using outputs from the Service only in contexts where you have the right to act on them.

5. Prohibited uses

You may not use the Service, directly or indirectly, to:

  • Attack, probe, scan, exploit, or attempt unauthorized access to any system, network, account, application, or data that you do not own or have written authorization to test.
  • Develop, distribute, or deploy weaponized malware (credential stealers, ransomware, info-stealers, RATs, wipers) intended for use against third parties.
  • Create phishing infrastructure, business email compromise (BEC) content, or social engineering material targeting real organizations or individuals.
  • Extract, recover, or operate on stolen data, credential dumps, or material obtained without authorization.
  • Stalk, harass, dox, surveil, defraud, blackmail, extort, or threaten any person.
  • Generate child sexual abuse material (CSAM), non-consensual sexual content, or content that sexually exploits minors.
  • Generate content that incites real-world violence against people or groups.
  • Violate the intellectual property, privacy, or other rights of any third party.
  • Resell, sub-license, redistribute, or proxy the Service, or use it to train a competing model, without our prior written consent.
  • Interfere with the Service itself: bypass rate limits, exploit billing flaws, scrape at industrial volume, deny service to other users, or attempt to circumvent our security controls.

We may, at our sole discretion, refuse, restrict, or remove access for any user we reasonably believe is engaged in or planning prohibited activity.

6. Your responsibility

You are solely responsible for everything you do with the Service and with any content the Service produces for you. This includes:

  • The decision to apply any AI output to a real system, person, or workflow.
  • Verifying that any technique, code, command, or recommendation is lawful and authorized in your specific situation before you use it.
  • The consequences (legal, financial, technical, reputational) of any action you take based on Service outputs.

WormGPT, its operators, employees, agents, model providers, and infrastructure providers are not responsible for how you choose to use the Service or its outputs.

7. Payments, plans, and refunds

  • Plans are sold for the durations described on the pricing page and paid in cryptocurrency through our payment processor (NOWPayments).
  • Access begins after the blockchain confirms your payment and a subscription record is created on your account.
  • Because this is a digital service delivered immediately upon payment confirmation, all sales are final and we do not offer refunds, except where required by law.
  • If you believe you were charged in error or experienced a technical failure, contact us via Telegram (@forsasuke) within 48 hours and we will investigate in good faith.
  • Prices, plan features, and rate limits may change. Changes apply to new billing periods.

8. Intellectual property

  • The Service, including the WormGPT name, logo, website, source code, prompts, design, and documentation, is owned by us and protected by applicable law.
  • You retain ownership of the prompts and content you submit to the Service. By submitting content, you grant us a non-exclusive license to process it for the purpose of providing the Service to you.
  • You may use AI outputs generated for you in your own work, subject to the Acceptable Use and Prohibited Uses sections above and to the rights of any third parties referenced in those outputs.

9. Privacy and data handling

  • We collect: email, username, hashed password, payment metadata, IP address and user agent for security logging, and your chat history.
  • We do not sell personal data.
  • AI requests are processed by our upstream model provider (OpenRouter and the model providers behind it) under their respective privacy terms. They may retain inputs and outputs for abuse monitoring per their policies.
  • You can delete your account at any time by contacting support; this removes your chat history, subscriptions, and payment records subject to legal retention requirements.
  • We process data in compliance with applicable data protection law, including the GDPR for users located in the EU/EEA. Lawful basis: contract performance for account and billing data; legitimate interest for security logs and abuse prevention.

10. Service availability and warranty disclaimer

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory, or otherwise, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation.

We do not warrant that the Service will be free of errors, that AI outputs will be accurate or appropriate for your use case, or that the Service will be available without interruption. Upstream AI providers, payment processors, mail providers, CDN, and hosting providers may experience outages.

11. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall WormGPT, its operators, employees, agents, model providers, or infrastructure providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, data, business opportunities, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service.

Our aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 100.

12. Indemnification

You agree to defend, indemnify, and hold harmless WormGPT, its operators, employees, agents, model providers, and infrastructure providers from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising from or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or any third-party right, or (d) any content you submit to or generate through the Service.

13. Suspension and termination

  • You may stop using the Service and request account deletion at any time.
  • We may suspend or terminate your account immediately, without notice and without refund, if we reasonably believe you have violated these Terms or applicable law, or if continued service would expose us, our providers, or other users to risk.
  • Sections that by their nature should survive termination (Prohibited Uses, Your Responsibility, IP, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

14. Changes to these Terms

We may modify these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top of this page and, where reasonable, announced inside the application. Your continued use of the Service after a change constitutes acceptance of the modified Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, except where mandatory consumer-protection law in your country of residence specifies otherwise.
